By signing this agreement, or otherwise enrolling, electronically, verbally, or engaging otherwise, in the course, you (“Client”) are entering into a legally binding agreement with www.unitedconstructors.net, registered under United Constructors Inc. as to be know as UCI, a Florida Corporation (“Company”), according to the following terms and conditions:
Participation. By signing up to become a student and attending any virtual or in person events with United Constructors Inc., you acknowledge and agree that your name, image, or likeness may be used by UCI for marketing and promotional purposes. This includes, but is not limited to, website content, social media posts, educational materials, and other promotional items.
COMPANY’S SERVICES. Upon execution of this Agreement, electronically, verbally, written or otherwise, the Company agrees to render services related to any and all business as defined by Florida laws. The terms of this Agreement shall be binding for any further goods/services supplied by Company to Client (Client defined as any interaction of individuals, member or subscriber of this website.) The scope of services rendered by Company pursuant to this contract shall be solely limited to those contained therein and provided for on Company’s website. Company reserves the right to substitute or change this terms and conditions, if the need arises.
CONFIDENTIALITY. The term “Confidential Information” shall mean information which is not generally known to the public relating to the Client’s business or personal affairs. Company agrees not to disclose, reveal or make use of any Confidential Information learned of through its transactions with Client, during discussion with Client, the coaching session with Company, or otherwise, without the written consent of Client. Company shall keep the Confidential Information of the Client in strictest confidence and shall use its best efforts to safeguard the Client’s Confidential Information and to protect it against disclosure, misuse, espionage, loss and theft.
CONTROLLING AGREEMENT. In the event of any conflict between the provisions contained in this Contract and any marketing materials used by Company, Company’s representatives, or employees, the provisions in this Agreement shall be controlling, unless a stand alone fully executed agreement has been signed by all related parties.
DISPUTE RESOLUTION POLICY. By executing this Customer Agreement, the Customer and the Company (United Constructors Inc.) hereby agree that any and all disputes that arise between them concerning the Customer Agreement or any terms of thereof, or that concern any aspect of the relationship between the Customer and the Company, shall be decided exclusively in binding arbitration conducted by the American Arbitration Association (“AAA”). Customer and Company further agree that each party will bear its own costs and attorney’s fees incurred in connection with the AAA arbitration proceedings.
ENTIRE AGREEMENT. This Agreement constitutes the entire agreement between the parties pertaining to the subject matter hereof and supersedes all prior and contemporaneous agreements, negotiations and understandings, oral or written. This Agreement may be modified only by an instrument in writing duly executed by both parties.
SURVIVABILITY. The ownership, non-circumvention, non-disparagement, proprietary rights, and confidentiality provisions, and any provisions relating to payment of sums owed set forth in this Agreement, and any other provisions that by their sense and context the parties intend to have survive, shall survive the termination of this Agreement for any reason.
SEVERABILITY. If any of the provisions contained in this Agreement, or any part thereof, is hereafter construed to be invalid or unenforceable, the same shall not affect the remainder of such provision or any other provision contained herein, which shall be given full effect regardless of the invalid provision or part thereof.
NON-DISPARAGEMENT PROVISION. Student, member or subscriber agrees that he/she will not disparage United Constructors Inc. or any of its officers, contractors or employees. For purposes of this Section, “disparage” shall mean any negative statement, whether written or oral, about The United Constructors Inc or any of the employees, officers or contractors of United Constructors Inc. The parties agree and acknowledge that this non-disparagement provision is a material term of this Agreement.
If any disparagement occurs, United Constructors Inc shall pursue all legal remedies allowed by law for slander, defamation and subsequent monetary damages caused by this action against the clients, potential clients, member or subscriber. Clients, member or subscriber will be responsible for legal fees.
OTHER TERMS. Upon execution by clicking “I Agree,” emailing your statement of agreement, sharing and entering your credit card information with the Company, or by signing an agreement or contract, or otherwise enrolling, electronically, verbally, or engaging otherwise, the Parties agree that any individual, associate, and/or assign shall be bound by the terms of THIS AGREEMENT.
Texting / SMS provision:
· You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

· Carriers are not liable for delayed or undelivered messages.
